Planning Board Minutes 05/11/2006
Minutes of meeting held at Guilderland Town Hall, Route 20, Guilderland,  NY 12084 at 7:30 P.M.

Chairman Feeney  called the meeting to order at 7:30 p.m.  He noted the exits for the sake of the audience in the event they were needed.

CASE OF SADDLEBROOK - Johnston Road



Chairman Feeney announced that this was a final plat presentation of a 43 lot subdivision of 106 acres.  Don Zee presenting. 



Jan Weston, Town Planner, read the comments of the Planning Department as follows:

Saddlebrook - Johnston Road

The Town Designated Engineer has reviewed and approved the final plat plans and I have no further concerns.  No objection to final approval.



Donald Zee presenting:  At the last hearing, the Board granted preliminary approval with certain conditions.  All of the conditions have been met except for one. Lonnstrom Road is a private road and  we did note it on the map. The Board was looking for a little more of a notation on the plans with regards to the triangular area at the end of the right-of-way area, and at the end of the lot off of Stonebriar Drive. That has been shown and will be dedicated to the Town and noted on the plans. The driveways off of Stonebriar Drive will include a T-turnaround, and that has been noted on the plans. We submitted to the town earlier,  a cross easement agreement for the private road, known as Lonnstrom Lane. We did contact the Westmere Fire Department and followed up with a letter dated April 7, 2005 and, to date, we have not received a written response from them. Our engineering firm did try to contact the Commissioner today and did not get any response as of yet. We submitted a draft of the HOA declaration and by-laws and filed an updated SWPPP.  We submitted the letter from the Army Corps of Engineers and their permit. We also submitted a copy of the Declaration of restrictive covenants regarding the wetlands.



Chairman Feeney stated: I do have a letter in the file from Boswell Engineering, the TDE, dated April 20, 2005, in regards to the Saddlebrook Subdivision.  Rob Osterhoudt is here tonight representing Boswell Engineering and is in agreement with the final plans. 



Chairman added: The one outstanding issue is that we do not have a letter or any correspondence from the Westmere  Fire Department for approval for emergency vehicle access on Lonnstrom Lane.



Chairman asked for any comments from the Board and there were none.

Chairman stated: At the last meeting, we did issue preliminary approval and this Board issued a negative declaration for the project with regard to the State Environmental Quality Review Act.



Chairman made a motion to approve the final plat for Saddlebrook with the following conditions:



· Town Highway Superintendent approval



· Town Designated Engineer approval



· Town Water & Wastewater Superintendent approval



· Albany County Health Department approval



· Albany County Highway Department approval



· $1,500 per dwelling unit-park & recreation fund (with building permit application)



· $2,085 per dwelling unit-sewer mitigation fee (with sewer hook-up application)



· Review and approval by Westmere Fire Chief for emergency vehicle access on Lonnstrom Lane.



The motion was seconded by  Thomas Robert and carried by a 5-0 vote by the Board.

MATTER OF BESCO - 5670 Depot Road



Chairman Feeney announced that this was a site plan review to allow contained outdoor storage. Zoned Industrial.  Mrs. Scoons presenting.



Jan Weston, Town Planner, read the comments of the Planning Department as follows:

Besco - 5670 Depot Road

The applicant would like to amend their special use permit to allow outdoor contained storage.  I have no objection to the use since this is an industrial zone.  However, there are numerous residential properties to the north and south along Depot Road and every effort should be made to properly screen the storage area from the neighbors and the roadway.



Mrs. Scoons presenting: We are proposing to use the outside storage containers for housing equipment and materials to be used on contract jobs on a temporary basis. Typical use will include storage of roof-top air handlers, louvers, exhaust fans, ductwork, etc.



Chairman Feeney stated: The comments from the Planning Department will be forwarded to the Zoning Board of Appeals. They would probably ask for fencing to block the view from the neighbors.



This is pretty straight forward and we'll be able to move this forward.



Chairman made the motion to approved this site plan for Besco with the following suggestion:

· Every effort to be made to properly screen the storage area from the neighbors and the roadway.



The motion was seconded by Terry Coburn and carried by a 5-0 vote by the Board.

MATTER OF SUNBURST ASSOCS. - 1726 Western  Avenue



Chairman Feeney announced that this was a site plan review to allow two additional tanning units in the lower level of the building.   Zoned BNRP.  Michael Vilardi presenting.



Jan Weston, Town Planner, read the comments of the Planning Department as follows:

Sunsations - 1726 Western Avenue

The applicant is requesting to amend his special use permit to allow 440 sq. ft. in the basement level to be used for two additional tanning beds.  In 1995, a special use permit was granted to integrate this site with 1724 Western Avenue, including shared parking and common drive aisles.

The use of the additional space will necessitate a variance for 5 parking spaces.  However, the two existing uses, Concord Pools and the tanning salon are complimentary seasonal businesses, and I have no objection to the site plan approval.



Michael Vilardi presenting: Giovanone Commercial Rentals owns this property along with Concord Pools next door.  The shop is at the corner of Johnston Road and Route 20 and along with the other building there. They all share a similar challenge with some of the entry- exit ways.  The businesses are divided by fences, only, and my suggestion is to see if they would take down the fences and do combined parking. 



Ms. Weston said that you should talk to the owners and see if they are willing to discuss this and speak with Mr. Cropsey, the town's chief building inspector, and set up a meeting at the Town Hall with the owners.



Terry Coburn wanted to know what type of exit do they have in the basement.



Chairman mentioned that the access would have to meet the building code.



Chairman asked for any other comments from the Board and there were none.

Chairman made a motion to approve the site plan for Sunburst Associates, to add two additional tanning units.



The motion was seconded by Thomas Robert and carried by a 5-0 vote by the Board.
